Terms of Service

These Terms of Service ("Terms") govern your use of the Sety mobile application (the "App") operated by Lumina Labs LLC ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use Sety. By using the App, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate information when creating your account

You must notify us immediately at info@setyworkout.com if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the App

Sety is a personal fitness tracking application. You agree to use the App only for its intended purpose and not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated tools to send partner requests or otherwise abuse the social features
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App in any way that could damage, disable, or impair our services

4. Health Disclaimer

Sety is not a medical application. The App is designed to help you track your workouts and fitness progress. It does not provide medical advice, diagnosis, or treatment.

• Always consult a qualified healthcare professional before starting a new exercise program
• Do not ignore professional medical advice because of something you read or tracked in the App
• If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention

We are not liable for any injury, health issue, or adverse outcome resulting from your use of the App or reliance on information logged within it.

5. Workout Partners Feature

The Workout Partners feature allows you to connect with other users, share workout templates, and share personal records. When using this feature, you agree to:

• Only send partner requests to people you know or who have consented to receive them
• Not harass, spam, or repeatedly contact users who have declined your requests
• Treat other users with respect

We reserve the right to disable your access to social features if you abuse them.

6. Your Data

You own the workout data you create in Sety. By using the App, you grant us a limited license to store, process, and sync that data for the purpose of providing the App's functionality.

You can delete your data at any time using the "Reset Data" option in Settings. To delete your account entirely, use the "Delete Account" button in the app.

7. Intellectual Property

The App, including its design, code, and content (excluding your personal workout data), is owned by Lumina Labs LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Any errors will be corrected
• The App or its servers are free of viruses or harmful components

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUMINA LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED $100.

10. Indemnification

You agree to indemnify and hold harmless Lumina Labs LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections 4, 8, 9, 10, and 12 of these Terms survive termination.

12. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Delaware.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
