Terms of Service

Welcome to Sety. These Terms of Service ("Terms") govern your use of the Sety mobile application ("the App"), operated by Lumina Labs LLC ("we," "our," or "us"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use Sety. By using the App, you represent that you meet this requirement. If you are under 18, you represent that you have permission from a parent or guardian.

2. Your Account

Account Creation

You may sign up using an email address and password or through Google Sign-In. You are responsible for maintaining the security of your account and for all activity that occurs under it. For security, certain sensitive actions such as account deletion require you to re-authenticate before proceeding.

Username

When you create an account, you will choose a username. Your username:

• Is permanent and cannot be changed after it is set
• Must be 3–20 characters and may contain letters, numbers, and underscores
• Must not impersonate another person, brand, or organization
• Must not contain offensive, hateful, or prohibited language
• Is visible to other authenticated users of the App

We reserve the right to reclaim or remove usernames that violate these Terms or that have been inactive for an extended period.

Account Termination

You may delete your account at any time through Profile → Delete Account. Upon deletion, your profile, profile photo, workout data, username, and partner connections are permanently removed. This action cannot be undone.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Profile Photos

Uploading a Profile Photo

You may optionally upload a profile photo. By uploading a photo, you represent and warrant that:

• You own the photo or have the legal right to use it
• The photo does not infringe the copyright, trademark, or other rights of any third party
• You have the consent of any identifiable person depicted in the photo
• The photo complies with the content standards set out below

Content Standards for Profile Photos

Profile photos must not contain:

• Nudity, sexual content, or explicit material
• Hateful imagery, symbols, or content targeting individuals or groups
• Graphic violence or disturbing content
• Content that promotes illegal activity
• Logos, trademarks, or branding you do not own

License

By uploading a profile photo, you grant Sety a non-exclusive, royalty-free, worldwide license to display the photo within the App to other users for the purpose of operating the App's social features. This license ends when you remove the photo or delete your account.

Removal

We reserve the right to remove any profile photo that violates these Terms without prior notice. Repeated violations may result in account suspension.

4. Acceptable Use

You agree not to use the App to:

• Harass, threaten, or harm other users
• Spam or send unsolicited communications to other users
• Impersonate any person or entity, including any Sety or Lumina Labs LLC employees or representatives
• Upload or share content that is illegal, offensive, or infringes third-party rights
• Attempt to gain unauthorized access to the App, our systems, or other users' accounts
• Reverse engineer, decompile, or modify the App
• Use the App for any commercial purpose without our written consent

5. Content and Conduct

You are solely responsible for the substance of any content you post, share, or transmit through the App. You agree that you will not upload, post, or otherwise distribute any content that:

• Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, or otherwise violates these Terms
• Victimizes, harasses, degrades, or intimidates an individual or group on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability
• Infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party
• Constitutes unauthorized or unsolicited advertising, spam, chain letters, or any other form of unauthorized solicitation
• Contains software viruses or any code designed to disrupt, damage, or gain unauthorized access to any system or data
• Impersonates any person or entity

No Pre-Screening of Content

We do not pre-screen, actively monitor, or edit content posted or shared by users of the App. We neither endorse nor assume liability for any user-generated content. However, we reserve the right at our sole discretion to remove any content that we determine does not comply with these Terms or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing such content. You consent to such removal and waive any claim against us arising from it.

Account Termination for Violations

We may at any time, at our sole discretion, suspend or terminate your account without prior notice for violating any provision of these Terms.

Law Enforcement Cooperation

We will cooperate fully with investigations of violations of systems or network security, including cooperating with law enforcement authorities in investigating suspected criminal violations.

6. Social Features and User Content

Workout Partners

The App allows you to connect with other users as workout partners. You control who you connect with. We are not responsible for the conduct of other users.

Shared Content

When you share workout templates or personal records with partners, those users can view and use that content. You retain ownership of content you create, but grant your partners a limited right to view and use shared content within the App.

Reporting

If another user is harassing you or violating these Terms, please contact us at info@setyworkout.com. We will investigate and reserve the right to take action we deem appropriate, including removing content or terminating accounts.

7. Premium Subscriptions

Sety Pro

Certain features are available exclusively to Sety Pro subscribers. Subscriptions are billed on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store.

Billing and Cancellation

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel your subscription through your App Store or Google Play account settings
• Cancellation takes effect at the end of the current billing period — you retain access until then

Subscription Lapse

If your subscription expires or is cancelled, you will lose access to Sety Pro features at the end of your current billing period. Your data — including workout history, personal records, and templates — will remain intact. However, access to features gated behind Sety Pro, including the use of templates created beyond the free plan limit, will require an active subscription.

Refunds

Refunds are handled by Apple or Google in accordance with their respective policies. We do not process refunds directly.

Price Changes

We reserve the right to change subscription pricing. We will provide reasonable notice of any price changes before they take effect.

8. Intellectual Property

The App, including its design, features, and content created by us, is owned by Lumina Labs LLC and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written permission.

You retain ownership of the content you create within the App, such as workout templates and personal records.

9. Disclaimers

Fitness Disclaimer

Sety is a workout tracking tool and is not a substitute for professional medical or fitness advice. Always consult a qualified healthcare professional before starting a new exercise program. We are not responsible for any injury, health issue, or other harm arising from your use of information in the App. Workout data tracked in the App, including personal records and volume metrics, is provided for informational purposes only and may not be fully accurate.

Service Availability

We do not guarantee that the App will be available at all times. We may suspend, withdraw, or restrict access to the App for business or operational reasons at any time without notice.

10. Platform Terms

If you download the App from the Apple App Store or Google Play Store, you also agree to their respective terms of service. In the event of a conflict between those terms and these Terms, the platform terms govern with respect to platform-specific matters.

11. Limitation of Liability

To the fullest extent permitted by law, Sety and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or personal injury. Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Sety and its operators from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the App, or your infringement of any third-party rights.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Pennsylvania.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Continued use of the App after changes constitutes your acceptance of the updated Terms.
